Terms of Service

Waysim · waysim.co · Support: support.waysim.co

Effective date: 7 October 2026

1. Who we are

The Waysim mobile app and the website waysim.co ("Waysim", "we", "us") are provided by the individual developer shown as the seller of the Waysim app on the App Store and Google Play, where the developer's name and contact details are also shown. Customer support: live chat in the app, support.waysim.co and support@waysim.co.

2. Agreement

By creating an account or buying a plan, you agree to these Terms, our Refund & Replacement Policy (waysim.co/refund), our Acceptable Use & Fair Use Policy (waysim.co/fair-use) and our Privacy Policy (waysim.co/privacy). If you do not agree, do not use Waysim. If these Terms are translated and the versions differ, the English version prevails.

3. Who can use Waysim

You must be at least 18 years old and able to enter into a binding contract. You may not use Waysim if:

• you are located in, or a resident of, a country or territory subject to comprehensive sanctions or to a U.S. Government embargo, or one designated by the U.S. Government as a "terrorist supporting" country; or
• you are named on a sanctions or restricted-party list of the United Nations, the United States, the European Union or the United Kingdom.

4. What we sell

Waysim sells prepaid mobile data plans delivered as eSIM profiles. The connectivity is provided by licensed mobile network operators through our connectivity partners. Waysim is not a mobile network operator.

• Plans are data-only unless the plan page says otherwise. They do not include a phone number, calls or SMS unless stated.
• Coverage, networks, speeds and validity are shown on each plan page. Actual speed and coverage depend on the local network and may vary. We do not guarantee uninterrupted service.
• Some plans support top-ups. Where a top-up is offered, it is shown on the plan page.

5. Your device

You are responsible for using a device that supports eSIM and is not locked to a carrier. Check the compatibility list in the app before you buy. eSIM profiles cannot be moved to another device once installed.

6. Your account

Keep your login details secure and your information accurate. Each account is for one person. You can delete your account at any time in the app under Settings, or at support.waysim.co/delete-account. Deleting your account cancels any unused Waysim Balance, so use it first.

7. Prices and payment

• Prices are shown in USD before you pay and include all Waysim fees and any taxes we are required to charge.
• At the moment we accept payment in cryptocurrency only, processed by a third-party cryptocurrency payment processor.
• You must send the exact amount, in the coin and network shown on the payment screen, before the payment window expires. Blockchain network fees for your payment are paid by you.
• Payments sent to the wrong address, network or coin may be lost permanently and cannot be recovered by us.
• An order is confirmed once the processor confirms the payment on the blockchain.
• If you pay less than the order amount, pay after the window expires, or pay more than the order amount, the amount we actually receive is credited to your Waysim Balance at its USD value at the time of receipt. If you prefer, you can ask us within 30 days to send it back to your wallet instead (section 4 of the Refund & Replacement Policy).
• We may change prices at any time. Changes do not affect orders already paid.

8. Delivery, installation and validity

• Your eSIM is delivered in the app, usually within minutes of payment confirmation.
• The QR code and activation details are for one device only and can usually be installed only once. Do not share them.
• For most plans, validity starts at the first connection to a supported network in the destination. Some plans start when the eSIM is installed. The plan page shows which applies.
• Unused data expires at the end of the validity period and does not roll over.
• If you delete an installed eSIM from your device, it may not be possible to reinstall it.

9. Refunds and Waysim Balance

Approved refunds are credited to your Waysim Balance. We do not send money back to your crypto wallet, except:

• where the law requires it, including the EU, EEA and UK right of withdrawal; or
• in the cases set out in section 4 of the Refund & Replacement Policy (a service that failed completely and could not be fixed, or money received without a completed order), when all of its conditions are met.

If your eSIM does not work for reasons covered by the Refund & Replacement Policy, or you bought the wrong plan and have not installed it, we replace the eSIM or refund the full price to your Waysim Balance.

Immediate start and right of withdrawal. Before payment you expressly ask us to deliver your eSIM and start the service immediately. You acknowledge that any right of withdrawal you have ends when the eSIM is delivered or, if the law treats the plan as a service, once the plan has been fully provided, and that if you withdraw earlier you pay for the part already provided. Details are in section 5 of the Refund & Replacement Policy.

Nothing in these Terms removes rights you have under consumer laws that cannot be excluded by contract.

10. Waysim Balance

Waysim Balance is store credit issued by us for refunds, replacements and over- or underpayments. It is not electronic money or a payment account. It can only be used to buy Waysim plans. It has no cash value, cannot be withdrawn, exchanged or transferred (except for refunds the law requires), and earns no interest. It does not expire while your account is active. It is cancelled if your account is deleted or terminated for breach of these Terms, unless the law requires otherwise.

11. Acceptable use

Plans are for personal use on smartphones and tablets while travelling. You may share data from your phone as a personal hotspot. You may not use plans in routers, dongles or IoT devices, resell them, or use them as a permanent replacement for a local mobile service. Full rules are in the Acceptable Use & Fair Use Policy.

12. Suspension and cancellation

We or the network operators may suspend or cancel an eSIM or account in case of fraud, abuse, abnormal usage, breach of these Terms, sanctions concerns or a legal requirement. We may refuse or cancel any order for the same reasons.

13. Support

The in-app live chat is our official support channel for all questions and problems. Help articles are at support.waysim.co. Support, refund, withdrawal and privacy requests can also be sent to support@waysim.co. Formal legal notices can also be sent to support@waysim.co. To help us resolve an issue quickly, share the eSIM ICCID (shown in the app) and screenshots of your device settings.

14. The app and our content

We grant you a personal, non-exclusive, non-transferable licence to use the Waysim app for its intended purpose. The Waysim name, logo and app content belong to us. You may not copy, modify or reverse-engineer the app.

15. App Store and Google Play

These Terms are between you and Waysim only, not Apple or Google. Waysim, not Apple or Google, is solely responsible for the app, its content, maintenance and support. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any); Apple has no other warranty obligation for the app. Waysim, not Apple, is responsible for any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims and claims that the app infringes third-party intellectual property rights. When using the app you must comply with any applicable third-party terms, including those of the App Store and Google Play. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.

16. Disclaimers and limitation of liability

The service is provided "as is" and "as available". To the extent permitted by law, we are not liable for indirect or consequential losses, such as lost profits, missed travel or roaming charges from another provider. Our total liability for any claim is limited to the amount you paid for the order that gave rise to the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

17. Changes to these Terms

We may update these Terms. We will show the new date at the top and notify you in the app before material changes take effect. Continued use after that means you accept the updated Terms.

18. Governing law and disputes

These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of your country of residence to the extent they protect you as a consumer, and you may bring a claim in the courts of that country where its law allows. Otherwise, disputes are resolved by negotiation through our support. Before starting any claim, please contact us through the live chat or at support@waysim.co; we will try to resolve the dispute in good faith within 30 days.
